In this case, John C. Harris man was indicted for murdering one David N. Miller. It appears tlxat the prisoner on being arraigned, pleaded not guilty; and thereupon the court proceeded to irnpannel a jury. The defendant then made application for a continuance, which was granted. Subsequently, October 30, 1848, a special term of the district court was held. Upon an affidavit previously filed by the defendant, that the sheriff was prejudiced against him, one Robert Rinkade was appointed elisor to return a jury.
