The plaintiffs, as the heirs at law of Grace Wilcher Usry, brought their action on the common law side of the court, against the defendant as the executor of John Usry deceased, to recover the sum of $1500.00. The plaintiffs alleged in their declaration, that John Usry, by the eighth item of his will, bequeathed the said sum of money to his granddaughter, which is in the following words: “ I give, bequeath and devise to my granddaughter Grace Wilcher Usry, one thousand dollars, to be paid to her at the close of my estate, by my executors whom I shall hereafter appoint,…
