Claimant brings this action against the State of New York for wrongful detention as the result of his incarceration in the penal institutions of this State from November 20, 1959 to December 19, 1961. The claim was timely filed with the Clerk of the Court of Claims and the office of the Attorney-General of New York State, and has not been assigned or submitted to any other court or tribunal for hearing or determination.
