Appeal from the JDeKalb Circuit Court. — Hon. W. S. ' Herndon, Judge. (1) The order of the township board directed to Levi Wood directing him to open the road should have been submitted to the jury. Appeal from the JDeKalb Circuit Court. — Hon. W. S. ' Herndon, Judge. (1) The order of the township board directed to Levi Wood directing him to open the road should have been submitted to the jury. The order required by section 8549, Revised Statutes, 1889, is the only order with which the road overseer has to deal. — This is an action based on sections 8675 and 8676, Revised Statutes, to recover damages.

The answer was that at the general election legally held on the Tuesday after the first Monday in November, 1880, in the county of DeKalb, the question of township organization was submitted to the qualified voters of said county under and pursuant to the provisions of chapter 162, Revised Statutes, 1879, at which election the majority of the legal voters of said county voting at said election for and against township organization, were for such organization, and the returns of said election were in…
