MEMORANDUM OPINION AND ORDER
LEON, District Judge.
Plaintiff, NovaCare, Inc., f/d/b/a Rehabilitation Hospital of Virginia, (“Nova- Care” or “the hospital”), a provider of services under the Medicare Act, brings this action to challenge the Provider Reimbursement Review Board’s (“PRRB” or “the Board”) decision to dismiss its 1994 appeal and to deny its request for reinstatement. Before the Court are the parties’ cross Motions for Summary Judgment.
