BICKS, District Judge.
This action for copyright infringement and unfair competition was instituted in 1952, against Clarence P. Oberndorf, as author, and Columbia University Press, as publisher of a book entitled “The Psychiatric Novels of Oliver Wendell Holmes”, first published in 1943 and revised in 1946. The individual defendant died during the pendency of the action and his executor, the Irving Trust Company, was substituted as a defendant.
