State v. Johnston
Court of Appeals of Washington
1Opinion of the CourtScholfield, J.
Sean R. Johnston appeals his juvenile court conviction for second degree burglary. He contends the trial court erred in failing to suppress physical evidence and his oral and written confessions because they were the product of an unreasonable seizure in violation of the Fourth Amendment. He also contends that the trial court erred in failing to suppress his oral and written confessions because they were obtained in violation of his Miranda rights. We agree that the police actions violated the Fourth Amendment; consequently, we do not reach the Miranda issue.
