— Appeal from a judgment of the County Court of St. Lawrence County, rendered July 17, 1978, upon a verdict convicting defendant of the crime of murder in the second degree. On December 3, 1977, defendant arrived at the 284 Club, a bar in the Village of Massena, New York, at approximately 2:00 p.m. and drank until about 6:30 p.m., when the bartender, John Carroll, refused to serve him any more drinks because of his annoying behavior involving a waitress.
