Appeal from a judgment of the Supreme Court, Monroe County (David D. Egan, J.), rendered January 29, 2004. The judgment convicted defendant, upon his plea of guilty, of manslaughter in the first degree.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.

Memorandum: Defendant appeals from a judgment convicting him upon his plea of guilty of manslaughter in the first degree (Penal Law § 125.20 [1]). We reject the contention of defendant that his indictment and prosecution for that crime are barred by double jeopardy. The original indictment…
