HICKS, Circuit Judge.

On November 10, 1942, Rufus Harold Hadden filed a voluntary petition in bankruptcy, was adjudicated a bankrupt and the proceedings were referred to a referee. No objections were filed to his discharge, which was granted on September 23, 1943.

On November 25, 1942, appellant, Personal Finance Company, Inc., of Kentucky, filed its proof of claim, which was allowed. On January 4, 1943, appellant filed its petition in which it sought an order adjudging that its claim was non-dischargeable under the provisions of Sec. 17, subsection 2 of the Bankruptcy Act, 11 U.S.C., Sec. 35,…
