In June, 1939, the Arkansas Portland Cement Company brought suit in the Cleburne circuit court against tbe appellant herein, J. H. (Howard) Bridwell, trading as Bridwell Mercantile Co. On September 18, 1939, a judgment by consent was entered against the appellant for $300.69, together with the costs and interest, the judgment providing that execution might issue after 60 days therefrom. Thereafter the appellant apparently paid all of the judgment except $39.22.
