Plaintiff Ezra L. Nolan was appointed Corporation Counsel of Jersey City on May 21, 1957. On May 5, 1959 the majority of the board of commissioners of the city adopted an ordinance terminating his service as of May 18, 1959. The Superior Court, Law Division, adjudged the action invalid and the Appellate Division affirmed. 56 N. J. Super. 480 (1959). We granted the application of the City for certification. Pesin v. Witkowski 31 N. J. 73 (1959).
