Appeals (1) from a judgment of the County Court of Chenango County (Castellino, J.), rendered March 13, 1990, upon a verdict convicting defendant of the crimes of rape in the first degree and sodomy in the first degree, and (2) by permission, from an order of the County Court of Madison County (Humphrey, J.), entered August 11, 1993, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment of conviction.
