Plaintiff, Benjamin Harvey Howard, filed a voluntary petition in bankruptcy on 19 May 1981, scheduling as one of his creditors Defendant, Roger W. Tipton. On 11 November 1981 the Trustee in Bankruptcy disclaimed and abandoned Debtor’s undivided one-half interest in residential real estate located in Montgomery County, Ohio.
