ELLIS, District Judge.

This is an employment discrimination case under the Rehabilitation Act of 1973, 29 U.S.C. §§ 791, 794 (the “Act”). Plaintiff, the executor of the estate of R.L. Wilkinson, claims that his decedent was the victim of employment discrimination by defendants on the basis of decedent’s handicap. More specifically, decedent was employed by the Federal Aviation Administration (“FAA”) as an Air Traffic Control Specialist.
