BARROW, Justice.

The parties, H. Rothstein & Sons, a private corporation, and Southern Pacific Company, a common carrier, will be referred toi as plaintiff and defendant, as in the trial court. This suit was brought by plaintiff against defendant, as initial carrier, to recover for loss and damages resulting from delay in delivering four cars of lettuce shipped by Fred R. Bright Company from El Centro, California, to plaintiff, H. Rothstein & Sons, at Philadelphia, Pennsylvania, by uniform bill of lading.
