The respondent commenced an action in the Circuit Court of Multnomah County, to recover the possession of certain real property situated in said county. The complaint is in the ordinary form, excepting that the allegation of the appellant’s possession and withholding the property is, that they are in possession, “or claim the possession of said above described real property as the owners thereof,” and wrongfully withhold the same from the respondent.
