The Petitioner moves to dismiss the above petitions pursuant to CPLR 3211 (a) (2) and (4), alleging there is a pending matrimonial action in the Supreme Court of Fulton County. The petitioner further requests that a previous order of the Family Court resulting from proceedings held subsequent to the commencement of the matrimonial action be vacated pursuant to CPLR 5015 (a). The respondent has filed an affirmation in opposition and a letter memorandum citing case law. Incredibly, the children’s Law Guardian has not submitted anything, leaving the children…
