KRUEGER, Judge.

The offense is murder. The punishment assessed is confinement in the State penitentiary for a term of three years.

The record shows that on the afternoon preceding the night of the unfortunate occurrence, the appellant and Juan Dominguez came from a ranch, where they were employed, to the City of Brownsville in an old pick-up truck.
