Appellant, Ramesh Patel, and Appellees, Tuttle Properties, LLC and BT’s Quick Mart, were engaged in a commercial real estate transaction. Appellant was unable to secure adequate financing to close the transaction, however, and Appellees retained his earnest money deposit. Appellant brought suit and the trial court granted summary judgment to Appellees.
