NIPPER, j.

— This is an original proceeding in habeas corpus, brought by the petitioner, Charles P. Noell, for the purpose of obtaining his discharge from the custody of Clarence Bender, Sheriff of Marion County, Missouri.

The -petitioner alleges that he is confined, detained, and restrained of his liberty by said Clarence Bender, in the city of St. Louis, which said detention and restraint is illegal; that the only pretext or cause of such arrest is by virtue of a writ or warrant of attachment, issued by William T.
