Presently before the Court is Defendant’s Motion for Partial Summary Judgment on Attorney’s Fees [327], For the reasons stated below, the motion is denied.
I. Standard of Review
Rule 56 provides that “[t]he court shall grant summary judgment if the movant shows that there is no genuine dispute as to any material fact and the movant is entitled to judgment as a matter of law.” Fed.R.Civ.P. 56(a); see also Sierra Club, Inc. v.
