JACKSON, Chief Justice.
The record shows that on July 16, 1935 W. P. Soash, M. G. Abernathy, J. M. Parkhill and W. F. Schenk made, executed and delivered their two prpmissory notes each in the sum of $91.45 to J. T. Harris payable to him on December 1, 1935 and February 1, 1936, respectively. C. M. Henderson acquired the notes and on April 28, 1939 he instituted suit in the County Court of Lubbock County against the makers of the notes, who were in default in the payment thereof, to recover the principal, interest and attorney’s fees as therein provided.
