This appeal arises from the involuntary bankruptcy of U.S. Coal Corporation and its subsidiaries. U.S. Coal is the parent of debtor Licking River Mining, a company that operated in eastern Kentucky. The appellants are East Coast Miner LLC, East Coast Miner II LLC, Keith Goggin, and Michael Goodwin, generally referred to as the "Licking River Lenders." The Lenders asserted a lien on substantially all of Licking River Mining's assets, including senior liens on all its cash collateral.
