Plaintiff American Home Assurance Company (“American Home”) filed this action 1 against its insured, pharmaceutical manufacturer Merck & Co., Inc. (“Merck”), seeking a declaratory judgment that American Home was not required to indemnify certain losses to shipments of products that Merck claims under a transit insurance policy bound and issued by American Home effective July 1, 2000 (the “Transit Policy”).
