MEMORANDUM DECISION GRANTING DECLARATORY AND INJUNC-TIVE RELIEF TO THE DEBTOR

The debtor, Francis Zarro, commenced this proceeding to prevent Ronald Scheck-ter from enforcing a state court judgment, and to recover payments made in partial satisfaction of the underlying debt. In the main, the dispute turns on whether Scheckter is seeking to collect a discharged, pre-petition debt or a valid post-petition debt unaffected by Zarro’s discharge.
