Tbis is an action on a promissory note for fifteen thousand dollars, executed by defendant to plaintiff. Tbe note was secured by a second mortgage on real estate, but plaintiff waived the security. From a judgment dismissing the action, plaintiff appeals.

The transaction out of which the cause of action arose is extremely complicated. ■ It can be best understood by a chronological narrative of the high lights, as shown by the testimony and documentary evidence.
