1Opinion of the Court

— In an action to recover damages for breach of an insurance contract, the defendant appeals from so much of an order of the Supreme Court, Richmond County (Amann, J.), dated May 23, 1991, as denied its cross motion for summary judgment dismissing the complaint.

Ordered that the order is affirmed insofar as appealed from, with costs.

On March 29, 1984, a windstorm damaged the plaintiffs premises located at 269 Howard Avenue, in Staten Island. The windstorm ripped the shingles off the roof, allowing rain and snow to enter and flood the plaintiff’s building over the course of several months.
