This is an action of trespass on the case for negligence that was tried to a jury in the superior court and resulted in a verdict for the defendant. Thereafter the trial justice granted the plaintiff’s motion for a new trial on the ground that the verdict was against the weight of the credible evidence. The case is here on the defendant’s exception to such decision.
