Appeal from Bibb Chancery Court. Heard before Hon. ThoImas H. Smith. Bill by V. Silvio against Georgiana Venturi as administratrix,, to enforce an equitable assignment of a bank deposit. Decree for complainant and respondent appeals.

Complainant (appellee) claimed that a certain savings deposit which stood to the credit of Rafaele Verturi on the books of the First National Bank of Birmingham had been equitably assigned to him by said Rafaele during his lifetime, and filed this bill against appellant, as Rafaele’s administratrix, to recover a judgment for the amount of the deposit. Appellant has collected the money from the bank, and the sole question is whether she should be held to account for it to complainant. Therefore the bank is not made a party.
