The controversy in this case is intimately connected with the case of Stebbins et al. v. Niles, heretofore before this court, and reported in 25 Miss. 267.
Pending the litigation in that case, Stewart and Sandford, as *79assignees of Niles, filed this bill, claiming tbe interest of Niles in tbe enterprise entered into by bim, and Stebbins and others, and praying for a settlement of accounts, and a distribution of tbe profits between tbe assignees of Niles, and tbe other parties in tbe land speculation.
