McGOWAN, Circuit Judge.

In a complaint filed in the District Court, two causes of action were asserted in respect of the fall by a small boy, 2% years old at the time of the accident, from the third-floor window of an apartment house. One was by the boy himself for damages suffered by him as a consequence of the fall; and the other was by his mother for medical expenses incurred by her in treating his injuries.
