CARLAND, District Judge.

This action was originally commenced in the district court of Washington county, Minn., and subsequently removed by the defendant in error to- the circuit court of the United States for the district of Minnesota, on the ground of diversity of citizenship. Maria Persons was the original plaintiff, but, she having died pendente lite, the action is now prosecuted by her executor.
