The appellant, Chester L. Graf, as plaintiff, claimed that he and the defendant, Wallace G. Woodruff, in May, 1925, formed a partnership under the style of Wallace G. Woodruff Construction Company for the purpose of operating a stone quarry near St. Croix, Ind., and furnishing crushed rock for the Hays Construction Company, which had a contract to build a certain road in southern Indiana.
