Following a jury trial Robert Murcer was convicted of two counts of Criminal Sale of a Controlled Substance in the Third Degree and one count of Criminal Possession of a Controlled Substance in the Third Degree (possession with intent to sell), New York Penal Law (“NYPL”) §§ 220.39 and 220.16.
