GARDNER, Justice.

The appeal is from a conviction of murder in the first degree, with the infliction of the death penalty.

Admittedly, on the night of June 20, 1935, defendant killed Addie S. Norman by shooting her with a shotgun, at the same time and with the same weapon also killing her husband, John E. Norman. Both victims were young people of pleasing personalities, and held in high esteem by the residents of their community.
