This is a proceeding in error brought to reverse a judgment of the district court for Lancaster county, denying the application of one Joseph Keller to be discharged upon a writ of habeas corpus, and remanding him to the custody of the warden of the state penitentiary. It is dis*495closed by the record, that on the 18th day of November, 1902, Joseph Keller, petitioner, was convicted in the district court for Cheyenne county, upon an information charging him with the larceny of eight head of horses of the value of thirty-five dollars each.
