McDONALD, Chief Justice.

This is a damage suit against a store owner because of an assault committed by an employee of defendant on the plaintiff while she was shopping in the store. Plaintiff contended that the defendant had notice of the danger to plaintiff but failed to remove such danger resulting in her injury; that defendant was thus liable for damages sustained. Trial was to a jury, and after plaintiff rested her case the Trial Court instructed a verdict against the plaintiff.
