Plaintiff Shirley Gustafson brought an action against Defendant Southland Life Insur anee Co. (“Southland”) for failure to pay life insurance proceeds on a $150,000.00 policy issued on the life of Plaintiffs decedent, Donald Gustafson (“Gustafson”). Am.Compl. Defendant filed a motion for summary judgment under Fed.R.Civ.P. 56(c) to prevent Plaintiffs recovery under the $150,000.00 policy.
