MEHAFFY, Circuit Judge.
Allen James Pitt, sometimes referred to as defendant, was convicted upon his plea of guilty under an indictment charging a violation of the Universal Military Training and Service Act, 50 U.S.C. § 462 et seq.
Pitt is a Jehovah’s Witness and was classified by his draft board as 1-0 (conscientious objector). After exhaustion of his administrative remedies, Pitt was ordered by his local draft board to report to it on June 1, 1966 where he would be given instructions to proceed to the place of employment for civilian work at the University of Missouri Medical Center,…
