Tbis was an action on account in tbe probate court of Kay county, in wbicb judgment was rendered in bebalf of tbe defendant, and for costs, and appeal taken to tbe district court by tbe plaintiff in error. Thereafter, upon motion of tbe defendant “to dismiss tbe appeal from tbe probate court in tbe above entitled cause for tbe reason that no appeal lies in such cases to tbis court,” tbe motion to dismiss tbe. appeal was sustained, to wbicb tbe plaintiff excepted, and took sixty days to present case made.
