(concurring and dissenting) : This is an appeal from a decree made by his Honor, Judge E. C. Dennis, and, as will appear by reference to the statement made in the decree, the case has been twice appealed to this Court. 112 S. C., 211; 99 S. E., 816; Id., 124 S. C., 391; 117 S. E., 807. To this decree, W- M. Hamer, and W. M. Rising, and the present trustees of Hugh P. Price’s estate have filed exceptions.
