GILL, Chief Justice.

Hugo Kastor brought this suit against Ludwig Oliven to recover the value of certain staves alleged to have been made by Oliven from timber belonging to Kastor and which Oliven wilfully, knowingly and unlawfully had cut and carried away.

The defendant being a citizen and resident of the German Empire, plaintiff sought to give the court jurisdiction by original attachment levied upon certain staves belonging to defendant and situated within the jurisdiction of the court.
