This suit was brought by the appellee against appellant to recover taxes due by appellant for the years 1892, 1895, and 1S96 upon a tract of 40 acres of land on the William Sherman survey in Houston county, owned by appellant, and to foreclose the tax lien upon said land.
The defendant demurred generally to plaintiff’s petition, and specially excepted thereto because it failed to show that the delinquent tax notice required by chapter 147 of the Acts of the Thirty-Fourth Legislature was given the defendant in the time required by said act, and because the petition shows upon its face that this…
