This is an action of contract or tort to recover damages for injury to the plaintiff’s goods while in the course of transportation by the defendant, a common carrier. The case comes to this court on an appeal by the plaintiff from a decision of the Appellate Division of the Municipal Court of the City of Boston dismissing the report of a judge of that court.
