-This is a proceeding by certiorari instituted in this court against the St. Louis Court of Appeals, requesting it to send up to this court the record in the case of Mill Creek, Fredericktown & Mine La Motte Special Road District, the plaintiff, and the Missouri Pacific Railroad Company, the defendant. It was out of that case these proceedings grew.
