Plaintiff Mary Gutierrez is a first lieutenant in the United States Air Force. She was involuntarily discharged pursuant to Air Force Regulation 36-12(40) [hereinafter sometimes referred to as “the pregnancy rule”] and her request for a waiver was finally denied by the.
