The plaintiff filed his nominating petition for the- office of county commissioner of schools with the defendant on the 29th day of January, 1935. He failed to also file an affidavit or other proofs establishing the facts which show his eligibility to hold such office, as required by 2 Comp. Laws 1929, § 7705, subd. (c), as amended by Act No. 122, Pub. Acts 1931. His attention was doubtless called to the omission, and .on the next day he complied therewith.
