The declaration is in assumpsit, and contains the usual money counts, with a special count,for the' use and occupation of two houses in Pitt township, and' for the use of a copper boiler in a brewery. ■ The cause was tried at the'lasi; Circuit Court for this county, (on the 30th of August, 1828,) before Justice *414Huston, when a verdict and judgment were rendered for the defendant.
