This was an action brought by the plaintiffs in error in the district court for Albany County, to, in effect, restrain the defendant from continuing trespasses upon a tract of one hundred and sixty acres of land in that'County. The plaintiffs claim title under a final certificate of purchase from the United States issued to one Simon Bales, a desert-land entryman, for lands embracing the lands in controversy, and by conveyance from Bales to plaintiffs.
